CD Package No.1: What Contractors Need to Know About the 2007 Updates to the AIA Documents and Consensus Documents

cdMr. Zimmerman joined Holland & Hart’s Salt Lake City office in 2003. Since 1989, his practice has focused on construction litigation, arbitration and mediation, as well as construction transactions. He is involved in representing clients in virtually all aspects of dispute resolution, including practicing before State and Federal Courts, mediations, and arbitrations. Mr. Zimmerman has experience representing owners, contractors, and subcontractors on a variety of construction-related disputes including prosecuting and defending mechanics’ lien and bond claims in connection with projects throughout the Western United States. He has represented clients on a host of different types of projects including golf courses, earthen dams, industrial facilities, highways, hotels, auto dealerships, condominiums, landscaping, strip malls and other retail facilities, and environmental remediation projects. He frequently represents clients in the drafting and negotiating of design and construction contracts for all project delivery methods and advises clients concerning selection, use and modifications to industry standard form contracts, including AIA, ACG, and EJCDC contracts for a host of different project delivery methods. Mr. Zimmerman is listed in Utah Super Lawyers in the construction/surety practice area. He was also included in the “Utah Legal Elite” in Utah Business Magazine (2008).

cdMs. Orien is an attorney at Holland & Hart LLP. While maintaining her practice in Salt Lake City, Ms. Orien also works in the firm’s Las Vegas office. Her practice focuses on construction litigation, green building and drafting and negotiating construction contracts. Ms. Orien represents owners, contractors, and subcontractors on a variety of public and private construction-related disputes. She has prosecuted and defended complex mechanics’ lien and bond claims involving delay and disruption, differing site conditions, defective plans and specifications, terminations, lost production, and liquidated damages. Ms. Orien is a LEED accredited professional and advises clients on green building projects and drafting and negotiating contracts for projects with a LEED certification goal. Ms. Orien also represents owners and contractors in transactional matters including negotiations and execution of construction contracts. Her contract drafting experience includes complex design-build contracts for large industrial projects, energy savings performance contracts, large infrastructure projects, and many multi-party construction transactions.

Ms. Orien is admitted to practice in Utah and Nevada.

cdJustin E. Scott is an associate attorney in the law firm of Babcock Scott & Babcock. Mr. Scott practices in the areas of construction litigation and insurance defense. He represents owners, developers, contractors, suppliers, engineers and homeowners in the prevention and resolution of construction claims and disputes. Mr. Scott has written several articles for magazines and newsletters addressing legal issues in the construction industry, including, “Subcontractor Construction Defects: Are You Covered,” Intermountain Contractor, April 2008. Mr. Scott also has given several lectures on construction related topics for various trade associations and other professional organizations. Mr. Scott was recently named to Utah’s Legal Elite for Construction Law and was also included on Super Lawyers’ Rising Star List. Mr. Scott is a member of the Utah State Bar and is active in the construction, litigation and alternative dispute resolution sections of the Utah Bar. cdD.J. Williams is a partner with the law firm of Stoel Rives (www.stoel.com). Among other practices, D.J. works in the Construction and Design section of Stoel Rives’ Litigation Practice Group. cdMr. Hilton has been a building inspector since 1978. He was also a plans examiner and building official for Sandy City. He currently is on contract with Cottonwood Heights and he has taught inspectors and classes over the years throughout the state of Utah. He served on two national committees: the International Conference of Building Officials and the International Code Council. He is a respected “expert” in his field.
